Federal Adjustments to Civil Money Penalties

Dear WIC Vendor Community,

Recent changes to the Civil Money Penalty (CMP) Inflation Adjustment for 2020 have resulted in an increase to CMPs for the Texas WIC Program.

Effective January 1, 2021, state policy WV: 1.0 will reflect the increased maximum CMP amounts the state agency will collect from a vendor in lieu of disqualification.

Currently, $15,041 is the maximum for each violation and $60,161 is the maximum for violations as part of a single investigation.

The new CMP maximum amounts are $15,306 for illegal sales conviction, $15,692 for each violation, and no more than $62,767 during a single investigation.
